2. Definitions
- Website - the prowebsite.bg website and all of its subpages.
- Provider - Pro Website EOOD (Про Уебсайт ЕООД).
- User - any person who browses the website.
- Client - a person or company with whom the provider has concluded a service contract.
- Services - development of a website or online store, monthly maintenance, hosting, SEO, local SEO, management of Google and social media advertising.
3. Use of the website
The content of the website is for information purposes. Browsing it is free and does not require registration. Sending an inquiry through a form does not create an obligation for either party and is not an order, but an invitation to a conversation and a quote. The processing of the data from the form is described in the Privacy Policy.
Automated downloading of content, attempts to break into, overload or disrupt the operation of the website, and sending spam through the forms are prohibited.
4. Services and packages
The services are offered in packages with a published price: a one-time fee for the development and a monthly subscription that includes the domain, hosting, SSL certificate, backups, updates, security, an agreed number of changes and a monthly report. Maintenance of an existing website, local SEO, an SEO subscription, Google Ads management and an SEO audit are offered separately.
The current packages, what each of them includes and their prices are on the Pricing page. The prices there are indicative for a standard scope. The exact scope and price are set in an individual quote and in the contract. The provider may change the published prices at any time, but the change does not affect contracts already concluded.
5. Ordering and conclusion of a contract
- Inquiry and conversation. You send an inquiry or call us. We clarify your business, your city and what the website needs to do.
- Demo and quote. We make a free demo of the homepage within 48 hours and send a written quote with the scope, price and timeline. The quote is valid for 14 days.
- Contract. When the quote is accepted, a written contract is concluded (including by email), which forms an integral part of these terms and conditions.
- Advance payment. Work starts after payment of a 50% advance of the one-time fee. The balance is paid on handover of the finished website.
- Handover. We show you the finished website, make the agreed corrections and launch the website live on the client's domain.
- Subscription. The monthly subscription starts from the date the website goes live and is invoiced monthly, in advance.
Every payment is made against a proforma invoice: by bank transfer to the provider's account with the proforma number as the reference, or by card through the payment link in it. The invoice is issued once the payment is received. If a payment is late, the provider may suspend work on current tasks until the overdue amount is paid.
6. Timelines and the client's cooperation
The indicative development timelines are 10-14 working days for the Start package and 3-4 weeks for the Business package and for an online store. These timelines apply when the client provides the materials on time: texts or source information, photos, logo, access to the domain and to existing accounts, and gives feedback on the demo within 3 working days.
The timeline is extended by the client's delay. The provider is not liable for delays caused by missing materials, late approvals or third parties (domain registrar, bank, courier company, Google).
7. Ownership, domain and termination
- The domain belongs to the client from day one. It is registered in the name of the client or the client's company. If it was registered by the provider, it is transferred to the client on request, free of charge.
- The website is the property of the client from the first day of its launch, including the design, the code and the content. The website is officially launched after the last payment under the order and the signing of a handover and acceptance report (приемо-предавателен протокол). From that moment the client has full access to the files and the database and may use them without restriction.
- If the subscription is terminated, the client receives a full copy of the website (files, content, database and the leads received) in a commonly used format and moves it to a provider of their choice. At the client's request, the provider helps move the website to hosting of the client's choice free of charge. The subscription covers hosting, maintenance and SEO, not the right to the website.
- The notice period for termination is 1 month and notice is given in writing, including by email, by either party. The subscription is payable until the end of the notice period.
- After 2 unpaid months of subscription, the provider may suspend the hosting and publication of the website, after a written warning and a 7-day period for payment. The domain remains the client's.
- Amounts paid for work performed and for subscription periods that have ended are non-refundable.
8. Copyright
Content provided by the client (texts, photos, logo, trademarks, product data) remains the client's property. The client warrants that they have the right to use it and is liable if they have provided third-party content without permission. The client grants the provider the right to use this content only to the extent needed to develop and maintain the website.
The design and code developed for the website become the property of the client in accordance with section 7. The provider retains the right to reuse its own templates, components and methods in other projects. Rights to elements licensed from third parties (themes, plugins, fonts, stock photos) follow their respective licenses.
The content of the prowebsite.bg website itself (texts, structure, images, code) is the property of the provider and may not be copied or republished without written consent. The provider may name the client in its portfolio only with the client's explicit consent.
9. Liability
- No guarantees are given for positions in Google. Rankings are determined by Google's algorithms, over which the provider has no control. The provider undertakes to carry out the agreed work and to report on it with real data from Google Search Console and Google Analytics, but does not guarantee specific positions, number of visits, number of inquiries or revenue.
- The same applies to advertising on Google and social media: the provider manages the campaigns professionally, but the result depends on the market, the competition, the budget and the client's offer.
- The provider is not liable for interruptions caused by third parties (internet provider, domain registrar, payment providers, couriers, Google), nor in cases of force majeure.
- The provider makes regular backups but is not liable for data loss resulting from actions of the client or of third parties with access to the website.
- The client is responsible for the lawfulness of their business and of the content they publish, including compliance with the requirements for online trade.
- The provider's total liability for damages is limited to the amounts paid by the client under the relevant contract for the last 6 months, to the extent permitted by law.
10. Complaints and dispute resolution
Comments on work performed are sent to [email protected]. We reply within 5 working days and fix free of charge any defects caused by our work, within the agreed scope.
Disputes are resolved through negotiation. If no agreement is reached, the dispute is referred to the competent Bulgarian court.
If the client is a consumer within the meaning of the Bulgarian Consumer Protection Act (ЗЗП), they have the right to file a complaint with the Consumer Protection Commission (kzp.bg) and to use alternative dispute resolution. The European Online Dispute Resolution platform is available atec.europa.eu/consumers/odr.
11. Governing law and changes
For all matters not covered here, the Bulgarian legislation in force applies, including the Electronic Commerce Act, the Obligations and Contracts Act (ЗЗД), the Consumer Protection Act and Regulation (EU) 2016/679 (GDPR).
The provider may change these terms and conditions. The current version is always at this address with its effective date. Changes that affect an existing contract are communicated to the client by email with 30 days' notice. If the client does not agree, they may terminate the contract without penalty.
